Board of Supervisors Resolutions
County Employees Retirement Law of 1937
FCERA operates under the provisions of the County Employees’ Retirement Law of 1937 (CERL) as adopted by the County of Fresno and Board of Retirement. The CERL contains both mandatory and optional statutory provisions. Mandatory statutory provisions are required for the correct administration of the system and are applicable to all retirement systems operating under the CERL. Adoption of the original CERL (in 1945) included provisions for automatic adoption of all future mandatory statutory provisions without further review by the County/Employers or the Board of Retirement.
Alternatively, optional statutory provisions must be adopted by either the County/Employers or the Board of Retirement depending on the provisions of the specific statute and will vary between systems.
FCERA has prepared the attached listing of the optional statutes that have been adopted for the operation and administration of FCERA over the years. Be aware that authority for the optional statutes can be rescinded, such as was done by the County of Fresno’s authorization of the purchase of prior public service. Thus, inclusion of a specific statute on the attached schedule does not guarantee that the provisions are available today.
